Terms and Conditions

Both parties will be obliged to sign a contract specifying the responsibilities and duties of both parties as well as detailing the contents of the particular package concerned. You may download a copy of this contract to look over at your convenience by clicking on this link . Remember though, this is a sample contract only, the package contents section will be different depending on your package. The contract is only valid if signed by both parties.
All packages include a disc containing the High Res (jpeg format) images included in your package. Apart from the above items, the packages all differ in regards to their contents and we suggest that you take the time to go over the package descriptions carefully, so as to choose the package that is right for you, and that accommodates your budget and aspirations.

What's Included?Included as standard with every package we offer is the following:
Travelling (if not more than 50km in total for the day), as many pre-wedding consultations as you require, the entire day's coverage, up to 10 hours'(except the 'Ruby' package which covers a total of 8 hours), and editing of the images that are included in the relevant package.
What's NOT included?If the total amount traveled exceeds 50km then a fee of R2.00 per km will be charged. Any images you may want to purchase above and beyond those specified in your package will be charged an additional amount of R8.00 per image (for editing). This does not apply to the Ultimate package as it includes all photos taken (minimum 1000) at your wedding, all fully edited.Download sample contract
ResponsibilitiesMedia Studio is responsible for ensuring that, in the event of illness, a suitably qualified photographer will be available to fill in. We are also responsible, should you choose to supply us with a shot list, to ensure that such list be complete. For a complete rundown of all the details please read the contract that will be signed by both parties carefully.
You, the client will be responsible for ensuring that seating, food and refreshments for the photographer and his assistant be available. You are also required to ensure that a family member be present during the group photo session to help facilitate the various family group photos.
Lastly, you need to be aware that there is to be no other photographers present that might impede Media Studio in the fulfillment of it's job of taking your perfect wedding photos.
Before you make any decisions, we would advise you to set up an appointment with Media Studio to come in and discuss your wedding in more detail, at which time any questions or requests you may will be dealt with.
The Contract or terms and conditionsENTIRE AGREEMENT:
This agreement contains the entire understanding between Media Studio Photography (PHOTOGRAPHER) and the CLIENT.
It constitutes a single integrated contract expressing the entire agreement of Bride and Groom and Photographer with respect to the subject matter hereof and supersedes all prior and contemporaneous oral and written agreements and discussions with respect to the subject matter hereof, and, except as specifically set forth herein, there are no other agreements, representations, promises or inducements, written or oral, express or implied, between the parties hereto with respect to the subject matter hereof.The only way to add or change this agreement is to do so in writing, signed by all the parties.
RESERVATION: Upon your signature, the Photographer will reserve the time and date agreed upon, and will not make other reservations for that time and date. For this reason, the Reservation Deposit of 50% of the cost of the revelant package is non-refundable, even if the wedding date is changed or the wedding is cancelled for any reason, including acts of God, fire, strike, civil disturbance and extreme weather. The reservation deposit is to be paid at time of signing this contract or within a period of no less than 24 hours thereafter.
INDEMMIFICATION: Bride and Groom shall indemnify and hold harmless Photographer from any loss, damage or liability resulting from Bride and Groom’s violation of the terms of this Agreement or any agreement involving Bride and Groom and the Photographer. Bride and Groom shall indemnify Photographer and hold him harmless from and against any claim by any other person or entity resulting from the performance of his services under this agreement.
Services supplied, Terms and Conditions
Photographer shall provide photography services for Bride and Groom consisting of:
PRE-EVENT CONSULTATION: The parties agree to a pre-event consultation before the event date in order to finalize the actual shooting times, locations, and CLIENT'S request list (in writing) for specific photographs. The client will be responsible for, or have someone designated, to identify people of whom specific photographs are desired and to arrange the neccessary permissions, if needed, to photograph the couple at various locations of their choosing. The consultation does not include any photography whatsoever. Should the client want a pre-wedding photoshoot this must be arranged with the photographer beforehand, and normal rates will apply.
PACKAGE CONTENTS: The following is a list of the contents and scope of work that is included in your purchased Wedding Package:
Full Day (up to 12 hours) shooting time.
250 Jumbo Prints
10 x A5 Prints
5 x A4 Prints
1 x A3 Print
The above listed photographs (266) on disc in high resolution jpeg format.
Additionally, a folder containing all the purchased images branded and optimized for web use will be supplied if desired.
One DVD Slide show of approximately 30 min duration with music (if the Client wants to include their own music a disc containing +\- 10 songs must be handed to Photographer). Media Studio reserves the right to edit the Slide show as it sees fit.
One A3 custom designed 24 page "Coffee Table" type album, design of which is at the discretion of Media Studio Editors.
TERMS and CONDITIONS:
1) It is understood and agreed that no other photographer will be allowed to photograph or take pictures at the wedding while the Photographer is working. Although it is permisable for guests to take photographs they should not interfere with the photographers ability to carry out his work. Should such activities lead to the photographer missing any requested shots he will not be held liable. Absolutely no third parties will be allowed during the official Bride & Groom photo session after the service.
2) Should the shooting time extend beyond 4 hours it is the clients responsibility to ensure that the Photographer and his assistant are provided with meals and non-alcaholic refreshments in a reasonable fashion.
3) All photographs, digital negatives and prints are protected by Copyright (all rights reserved). The Photographer retains the copyright to all photos and images taken and produced. The Client may reproduce any purchased images in any manner they see fit for sharing and enjoyment of friends and relatives. The Client must obtain written permission from the Photographer prior to the Client or their friends and relatives publishing or selling the photographs for profit.
4) Any photographs that the Client wishes to display on a website or on any other internet related medium must display the Media Studio logo in an unobtrusive manner. These branded images will be supplied to the client, and will be resized and optimised for the web by Media Studio. Images not displaying the Media Studio logo are strictly prohibited from web or internet use. Should the client require the use of the images on the internet, the client must ask Media Studio to supply such images to him/her. This will not be a chargable service.
5) The balance of the agreed fee must be paid in full on or before the day of the wedding. Any extra images and prints ordered afterwards will be charged seperately at normal rates. The client is required to return the selected choice list no later than a period of one month after receiving their selection disc. Failure to do so will result in a penalty of R25.00 per day being applied. If no selection list is returned for a period of two(2) months, all agreements will be deemed null and void.
6) Due to the nature of the business, and the sometimes long periods between booking and the actual wedding day, Media Studio cannot guarantee that printing cost will not increase from the time of booking, and therefore reserves the right to change package contents in a reasonable manner without prior notice. We will inform the client of any such changes as soon as they occur, and will not be held liable for any changes in package structures arrising from rising printing costs.
7) In the unlikely event of severe medical, natural, or other emergency it could be necessary to retain a different photographer. The Photographer will make every effort to secure a skilled replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. The Photographer takes the utmost care with respect to exposure, transportation, and processing the photographs including using professional grade equipment and professional grade backup equipment. However, in the unlikely event those photographs have been lost, stolen, or destroyed for reasons within or beyond the Photographer’s control, neither the Photographer nor Media Studio will be held liable for any loss.
8) If any provision of this agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and the other provisions of the agreement shall remain in full force and effect.
9) All packages include the amount of photographs purchased according to your package on disc. This does not include ALL the photographs taken at the wedding. The photographs that pass our quality control are then put on your selection disc from which you will then choose your alloted amount of images. Images chosen above the alloted amount will be charged at regular rates.
10) The Client hereby grants to the Photographer and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the Client or in which the Client may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The Client hereby releases the Photographer and his legal representatives and assigns from all claims and liability relating to said photographs.
11) The photographer is also hereby absolved of any liability for damages of any kind or nature due to the content captured in the photographs, arrising from their use, be it print, electronic or any other means. This includes damage to attire, clothing, wedding gowns etc.
12) This contract has been freely negotiated and shall be recognized as the entirety of the agreement, and only those changes or modifications specifically placed in writing, attached, signed and dated by the Client and the studio at the time of this signing shall be recognized as amendments to this contract.
